Policy Notice for TikTok Subscribers

By accessing and subscribing to our online films via the TikTok platform, you (the "Subscriber") agree to the following terms and conditions:

1. Copyright Protection
   All films available through our TikTok subscription service are protected by copyright laws, and the copyrights are owned by the respective filmmakers or rights holders. Subscribers are strictly prohibited from copying, reproducing, sharing, downloading, redistributing, or distributing any content accessed through this platform, whether in full or in part, without prior written consent from the copyright holder. Unauthorized use of any content may result in immediate termination of your subscription, as well as legal action. All rights, including but not limited to, intellectual property rights, remain with the filmmakers or their authorized agents.

2. Liability Waiver and Indemnification
   By subscribing to and using our service, you agree to indemnify, defend, and hold harmless the Sydney Women’s International Film Festival ("SWIFF"), its affiliates, partners, directors, employees, and agents (collectively referred to as "SWIFF Entities") from and against any and all claims, damages, liabilities, losses, costs, expenses (including legal fees), or other consequences arising from or related to (i) your use of the service, (ii) your violation of these terms, or (iii) any infringement of copyright or intellectual property rights by you. You acknowledge that SWIFF Entities will not be liable for any loss, damage, or harm, including indirect or consequential damages, arising from your use or inability to use the service

3. Content Classification and Age Restrictions
   Some films available through our platform may not have been rated by formal classification bodies and may contain content that is not suitable for all audiences. As such, we strongly recommend that all films be viewed only by mature audiences who are capable of understanding and processing the content. TikTok subscriptions are only available to users who are 18 years of age or older. By subscribing, you confirm that you meet this age requirement and that you are of sound mind to process and comprehend the mature content presented. You further agree not to share the content with anyone under the age of 18 or with individuals who may not have the cognitive ability to appropriately engage with 18+ content. It is your responsibility to ensure that only those who are fully capable of understanding the material have access to these films.

4. Content Availability and Modifications
   SWIFF reserves the right to modify, update, or remove any content, or change the availability of films, at any time and without prior notice. While we strive to ensure content is available for the full term of your subscription, we cannot guarantee continuous access to specific films. Changes to the content library may occur at our sole discretion.

5. No Refund Policy
   All subscription payments are final. Once a subscription is processed, it is non-refundable for any reason, including but not limited to dissatisfaction with content, service, or platform functionality. By subscribing, you acknowledge and accept that there are no refunds for any reason.

6. Film Distribution and Sharing
   You understand that films shared through our TikTok subscription service are provided exclusively for personal, non-commercial use. Any unauthorized distribution, including but not limited to sharing, uploading to other platforms, or using the films for commercial purposes, is strictly prohibited. SWIFF and the filmmakers reserve the right to take legal action against any individual or entity found in violation of this provision.

7. Termination of Subscription
   We reserve the right to terminate or suspend any subscription at any time for violations of these terms, including but not limited to improper use, abuse of the service, or illegal distribution of content. Termination will result in immediate loss of access to all films and content available through the subscription.

8. Governing Law and Jurisdiction. By using this website, you agree that any disputes arising out of or in connection with your use of this website, including any legal actions or proceedings related to the Sydney Women's International Film Festival, will be governed by and construed in accordance with the laws of New South Wales, Australia. You further agree that any legal action or proceedings relating to such disputes will be exclusively subject to the jurisdiction of the courts located in New South Wales, Australia, and you waive any objections to the venue or jurisdiction of these courts, including claims based on the inconvenience of the forum.
